Terms of the Auction
Terms and conditions for the VETS x Harley-Davidson Bike No. 1776 charity auction.
Last modified: November 2, 2026
These Terms of the Auction apply to everyone who registers or bids in this auction. By placing a bid, you agree to them.
1. The Auction
This auction is run by VETS: Veterans Exploring Treatment Solutions, Inc. (“VETS”), a nonprofit organization exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code. VETS is the sole sponsor and administrator of the auction. Harley-Davidson Motor Company, Inc., its affiliates, and its dealers are not sponsors, partners, administrators, or operators of this auction, do not endorse VETS or this auction, and are not responsible for it.
The auction is hosted on the BidJS platform operated by bidlogix. If the platform’s terms conflict with these Terms, these Terms control.
There is one lot: a 2026 Harley-Davidson 1776 Super Glide (FXD), No. 1776 of 2,500, White Onyx Pearl, VIN 1HD1BK911TB037832, with approximately 10 miles (the “Motorcycle”), together with the items listed in Section 6. VETS owns the Motorcycle.
Bidding opens on November 5, 2026, at 8:00 a.m. Central Time and closes on December 12, 2026, at 8:00 a.m. Central Time, subject to extended bidding under Section 3.
2. Eligibility and Registration
To bid, you must be at least 18 years old, a resident of the United States, and legally able to purchase, title, and register a motorcycle in your state of residence.
You must register for a bidding account through the auction platform and provide accurate information. VETS may require identity verification, a valid payment method, or other information before accepting bids or completing a sale.
VETS may refuse or cancel any registration, and may reject any bid, in its discretion. VETS directors, officers, and employees may not bid.
3. Bidding
The starting bid is $5,000, and each bid must be at least $500 more than the current high bid. There is no reserve price.
Every bid is a binding offer to buy the Motorcycle at the amount bid and cannot be withdrawn. If two bids are for the same amount, the bid received first wins. The time recorded by the auction platform is final, and late bids will not be accepted.
Extended bidding: if a bid is placed in the last 5 minutes before the scheduled close, the close will be extended by 5 minutes, and this repeats until no bids are received during an extension.
VETS may withdraw the Motorcycle, or modify, extend, suspend, or cancel the auction, at any time before the sale is completed, including because of errors, technical problems, or suspected fraud.
4. Winning and Payment
The highest valid bid accepted by VETS when bidding closes wins. VETS will notify the winning bidder by email at the address in the bidder’s account.
Payment in full must be received within 72 hours after notification by wire transfer or ACH transfer. There is no buyer’s premium.
If payment is not received on time, VETS may cancel the sale, offer the Motorcycle to the next highest bidder at that bidder’s last bid, or relist the Motorcycle, and may disqualify the non-paying bidder from future VETS auctions.
All sales are final. No refunds will be issued once payment is complete, except as provided in these Terms.
5. Fair Market Value and Tax
VETS’s good-faith estimate of the fair market value of the Motorcycle and included items is $15,999.00. Only the amount of a winning bid that exceeds this value may be deductible as a charitable contribution for federal income tax purposes. Bidders should consult their own tax advisors. VETS will provide the winning bidder a written acknowledgment.
The winning bid does not include sales or use tax, title, registration, license, inspection, or other governmental fees. These are the buyer’s responsibility and are paid by the buyer to the appropriate taxing and titling authorities in the buyer’s state. The taxable value is determined under the buyer’s state law and may differ from the winning bid. VETS does not collect or process these amounts.
After payment clears, VETS will provide the buyer the manufacturer’s certificate of origin, assigned to the buyer, an odometer disclosure statement, and a bill of sale. The buyer is responsible for completing all paperwork required by the buyer’s state, and for confirming before bidding that the Motorcycle can be registered there.
6. Delivery and What Is Included
VETS will arrange white-glove delivery of the Motorcycle at no additional cost to an address anywhere in the United States designated by the winning bidder. Delivery is expected within 7 days after payment clears, subject to carrier scheduling. The Motorcycle will be professionally detailed before delivery.
The sale also includes the following collector items:
- Certificate of Authenticity (No. 1776 of 2,500)
- Custom engraved display plaque signed by Marcus and Amber Capone
- $500 Harley-Davidson gift card
- Limited-edition 250-Year VETS challenge coin
- Signed 1776 Harley commemorative photo
The buyer must make the Motorcycle available to be received, and sign the delivery receipt, at the scheduled delivery. Risk of loss passes to the buyer upon delivery. If the buyer does not accept delivery within 30 days after payment, VETS may charge reasonable storage costs or, after written notice, cancel the sale and refund the amount paid less those costs.
7. Condition and Warranty
The Motorcycle is described on the auction page for identification. The Motorcycle’s standard written limited factory warranty from Harley-Davidson transfers to the buyer, subject to the warranty’s terms, conditions, exclusions, limitations, registration requirements, and commencement date. The warranty is provided solely by Harley-Davidson, and VETS is not a warrantor.
EXCEPT AS STATED ABOVE, THE MOTORCYCLE AND INCLUDED ITEMS ARE SOLD “AS IS.” VETS MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8. General
Assumption of risk and release. THE BUYER ASSUMES ALL RISKS ARISING FROM THE OWNERSHIP AND OPERATION OF THE MOTORCYCLE AND RELEASES VETS, HARLEY-DAVIDSON MOTOR COMPANY, INC., ITS AFFILIATES AND DEALERS, AND EACH OF THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND VOLUNTEERS FROM ALL CLAIMS ARISING FROM THIS AUCTION OR THE OWNERSHIP OR OPERATION OF THE MOTORCYCLE, INCLUDING CLAIMS ARISING FROM VETS’S OWN NEGLIGENCE. This release does not limit any rights the buyer may have under the manufacturer’s written limited warranty.
Limitation of liability. VETS’s total liability in connection with this auction will not exceed the amount the buyer paid to VETS. If VETS cancels a sale after payment, its sole obligation is to refund the amount paid.
Governing law and disputes. These Terms are governed by Texas law. Any dispute will be resolved exclusively in the state or federal courts located in Tarrant County, Texas.
Privacy. Information you provide to register and bid is handled under the VETS Privacy Policy and the auction platform’s privacy policy.
Use of proceeds. Proceeds support the general mission and programs of VETS, a nonprofit organization serving veterans nationwide.
Changes. VETS may update these Terms before bidding opens. The version posted when you place a bid applies to that bid.
